Terms of Service

These terms govern your use of Lothound. By using the service — or by ticking the disclaimer checkbox at signup or before paid-tier checkout — you agree to the limits below.

The service

Lothound is a deal-intelligence and aggregation service. We ingest listings from third-party auction and surplus sites and surface them with buyer-specific ranking and landed-cost math. We do not own, inspect, authenticate, or warrant the lots that appear in our alerts.

No guarantee of condition or functionality.

Listings, photos, and descriptions are passed through from the source auction. Lothound does not inspect any lot, does not guarantee that a lot is operational, complete, or fit for any particular purpose, and does not warrant the accuracy of any condition note a buyer or seller attaches to the lot. Always read the source auction’s listing and photos directly before bidding.

No guarantee of source-auction accuracy.

Our data comes from third-party auction and surplus sites — GovDeals, GovPlanet, Public Surplus, Cox, and HigherGov (and similar municipal / federal feeds). Those sites can contain misrepresentation, mistakes, or omissions. Lothound does not verify, and cannot guarantee against, errors in their listings or metadata, including quantities, model numbers, condition descriptions, photos, or auction timing.

No guarantee of resale outcomes.

Comparable-sales bands and landed-cost math are estimates, not promises. Resale prices, time-on-market, and recovery outcomes depend on factors outside Lothound’s control — local demand, freight costs, condition, market timing — and we make no warranty — express or implied — about any future sale price, time-on-market, or profit on a lot surfaced through the service.

How claims are framed.

Some listings carry an explicit verification level. Read it before you bid.

  • Photo-verified — a Lothound reviewer has matched the auction photos against the live lot and confirms the listing is the lot shown, not a stock or representative photo. This is a match-against-photos check, not a condition or functionality check.
  • Third-party inspected — the auction house or seller has run a functional or condition check, and Lothound passes that report through without re-inspecting it.
  • Untagged listings— every other listing has no tagged verification level and must be read with the limits in §§ 2–4 above.

Liability cap.

To the maximum extent permitted by law, Lothound’s total aggregate liability to you for any claim arising from the service is capped at the total fees you have actually paid us in the twelve (12) months immediately before the event giving rise to the claim. In no event is Lothound liable for your lost profit, lost resale, lost business opportunity, or any indirect, incidental, special, or consequential damage, even if Lothound has been advised of the possibility of such damages.

Acknowledgement.

Using the service — or ticking the disclaimer checkbox at signup or before paid-tier checkout — is acknowledgement of §§ 2–6 above. If you do not accept those limits, do not use the service.
